Welcome to Gem Dance — we’re so glad you’re here!

By booking a class, course, private lesson, or enrolling in a membership or program, you agree to these Terms & Conditions. This forms a contract between you (the dancer) and us (Gem Dance, 8671 – 91 Street, Edmonton, Alberta).

1. Definitions & Interpretation

Key terms used in these Terms & Conditions:

  • Benefits: Classes, private lessons, programs, workshops, and services you’re entitled to through your registration, package, or membership.
  • Contract: The agreement between you and Gem Dance, including registration and these Terms & Conditions.
  • Enrolment: Completed registration form, online booking, or confirmation submitted to join a class, membership, or private lesson.
  • Gem Dance / We / Us / Our: The business at 8671 – 91 Street, Edmonton, Alberta, and any associated instructors or representatives.
  • You / Your / Participant: The person registering or attending a class, event, or program.
  • Start Date: Your confirmed registration or membership start date.
  • Membership: Any ongoing program or pass granting recurring access to classes or services.
  • Paid in Full: Payment for a class, course, or membership upfront rather than recurring.
  • Private Lesson: One-on-one dance sessions booked directly with Gem Dance or an approved contractor.
  • Rules: Conduct guidelines for all students, visitors, and instructors.
  • Website: www.gemdance.ca or any official Gem Dance digital platform.

2. Studio Rules

By attending Gem Dance, you agree to follow our community guidelines. Breaches may result in reminders, warnings, or suspension. You may be financially responsible for harm or damages caused. Our goal: a safe, inclusive, and respectful space for all dancers.

3. Membership Information

Memberships give access to classes, benefits, and discounts. Membership options may change with 15 days’ notice. Types include:

  • 4-Month Membership: Paid in full
  • 2-Month Membership: Paid in full
  • Monthly Membership: Flexible, pay-as-you-go
  • Student Monthly Membership: Requires proof of student status

Any membership changes must be submitted via official forms.

4. Health & Injuries

Participation is at your own risk. You must inform Gem Dance of medical conditions or injuries. Staff are not medical professionals. You consent to receive emergency treatment if necessary and release Gem Dance from related liability.

5. Studio Rights

Gem Dance may request medical clearance or deny participation for safety. We prioritize your wellbeing and safety.

6. Age & Guardianship

Participants under 18 require a guardian to sign forms. Guardian responsibility includes fees, supervision, and support of studio policies. Minors attend during staffed hours only.

7. Payments

Payments are your responsibility. Use of third-party processors (e.g., Square) is standard. Keep info updated. Missed payments may result in late fees or temporary suspension. Fee changes receive 15 days’ notice.

8. Cancellation

Submit cancellations via our official online form. Final payment may be required. Medical, relocation, or “Fair Play” exceptions apply. Minimum term cancellations may require payout.

9. Termination by Gem Dance

Membership may be terminated for serious or repeated breaches, non-payment, false info, unsafe behavior, or illegal activity. Fees may be recovered and third-party collections used.

10. Membership Transfer

Transfers to another eligible participant require forms and full payment of outstanding fees.

11. Private Lessons

  • Pay in advance
  • Cancel ≥24 hours in advance (direct communication to instructor)
  • Make-up sessions possible within the same cycle
  • Non-refundable if missed without proper notice

12. Personal Information

Keep your info current. Gem Dance uses it for services, payments, and safety. Privacy Policy applies.

13. Internet & Social Media

Respectful use only. Do not post inappropriate content or share others’ images without consent. Gem Dance is not liable for personal device issues.

14. Limitation of Liability

Gem Dance provides services with care, but participation carries risk. Staff are not liable except in cases of gross negligence. You are responsible for belongings and property damage.

15. Emergencies

Follow emergency procedures. Staff instructions and posted plans must be followed. Call 911 for serious incidents.

16. Changes to Terms

Updates may include pricing, hours, schedules, services, and policies. Posted changes take effect immediately. Continued use equals acceptance.

18. Complaints & Feedback

Report concerns to staff first, then Studio Manager if unresolved. Harassment or mistreatment should be reported immediately.

19. Other Terms

Gem Dance is not liable for disruptions beyond control (e.g., disasters). Partial non-enforcement does not waive rights. Terms governed by Alberta law.

20. Studio Policies

  • Payment: Fees due at registration. No access until paid.
  • Withdrawals/Refunds: Only for medical reasons with a doctor’s note. Proportionate refund less $25 processing fee.
  • Photo Release: Permission granted for publicity images/videos.
  • Missed Classes: Make-ups allowed within session only; non-transferable.
  • Waiver & Release: You accept inherent risks and release Gem Dance from liability, including injury, loss, or death.
